Research Article

The Journal of Ankara University Faculty of Law aims to support developments in all areas of law by including original scientific research and reviews. The Journal considers qualified and original scientific studies as efforts that serve the modernization goal of the Republic of Turkey and the aim of becoming an advanced state of law with a complete democracy. In this context, the Journal considers new problem areas arising from technology and other dynamics specific to our age, in addition to the ancient problems of law, as priority scientific research topics. In addition, the Journal of Ankara University Faculty of Law considers contributing to the level of scientific studies in the field of law in Turkey to reach the highest international standards prevailing in the world among its main objectives. Within this framework, the Journal is an academic and refereed journal published four times a year (March, June, September, December) in print and electronic media.

The main problems encountered in the field of law in Turkey and in the world, scientific solution proposals and new theories are the primary areas of interest of the Journal. In this context, works that contain innovative approaches to their subjects, scientifically examine legal concepts and institutions, examine field research and their results, and translations with high academic value are among the works that can be published in the Journal. Translations of judgments cannot be published in the Journal. In addition to the works prepared in Turkish, it is also possible to publish scientific studies prepared in other foreign languages (German, English, French) deemed appropriate by the Editorial Board in the Journal of Ankara University Faculty of Law.

The target audience of our journal consists of professionals, experts, academicians, researchers, specialisation and doctoral students working in the field of law, as well as undergraduate and graduate students studying in related fields.

NOTE: Our journal accepts articles continuously and there is no time limit for article submission.

WRITING RULES AND PUBLICATION PRINCIPLES

DergiPark SYSTEM OBLIGATION
As of 27.10.2020, only the articles sent via the “Dergipark” system will be taken into consideration and the articles sent to “auhfd@law.ankara.edu.tr” will not be taken into consideration.

ORCID AND ROR ID NUMBER REQUIREMENT
In all manuscripts submitted for evaluation at AÜHF, authors are required to obtain an ORCID number (Scientific Researcher Identification Number) and upload their manuscripts and ORCID numbers to the Dergipark system. In addition, authors are required to indicate the ROR ID information of the institution they are affiliated with in the text of the manuscript. Institutional ID information can be accessed at https://ror.org. ORCID Number can be obtained from https://orcid.org/signin.
Studies of researchers who do not provide ORCID and ROR ID access will not be evaluated.

WORD LIMIT
The text of the articles submitted to the journal should not exceed 15,000 words. Manuscripts exceeding the word limit will be returned without being taken to the referee process.
Abstracts, bibliography and footnotes are not included in the word limit for the text. Turkish and English abstracts should be at least 150 words and should not exceed 200 words. 5 (five) keywords must be identified and included with their English versions. The text of the article, Turkish and English (Abstract) abstracts, references and footnotes should be prepared in “Microsoft Word” program using “Times New Roman” font and 12 pt. font size with 1.5 line spacing in accordance with the following procedures.

SPELLING RULES

1) Manuscripts submitted to the journal must not have been published or submitted for publication elsewhere.

2) The article must be prepared in accordance with the current spelling rules accepted by the Turkish Language Association and the rules given in this text. In case of non-compliance, the Editorial Office may request that the manuscript be reorganized and resubmitted in accordance with the relevant rules.

3) It is recommended that articles are uploaded to the system at least 45 days before the issue in which they are planned to be published. This period is not an assurance that the article will be published, but only a prerequisite for evaluating the possibility of publication.

4) The manuscripts that are initially evaluated by the Editorial Commission will be sent to the referees, and it will be decided to publish the manuscript in line with the reports of the referees, to request corrections from the author within the framework of the reports or to reject the manuscript, and the author will be notified as soon as possible. In the event that corrections are requested in the referee's report, changes can only be made by the author within the framework of the specified corrections. The journal will also include articles, translations, judgments and book reviews, legislative evaluations and informative notes. The acceptance or rejection of such articles will be made by the Editorial Commission. If the articles are accepted for publication, the copyrights of the work are transferred to our journal under the CC-BY-NC-ND license.

5) TITLE AND AUTHOR NAME: The main title of the article should be written in 14-point font, all letters capitalized, bold and centered. The author's name and surname should appear to the right of the title. The author's name should be written in 13 pt, bold, right justified, with capitalized first letters. At the end of the author's surname, there should be an asterisk containing the author's title, institution, field, e-mail address, ROR ID and ORCID information. ROR ID, ORCID and e-mail addresses in the text of the article should be provided with a URL link.
Ethical statements (e.g., funding, acknowledgments, derivation from thesis, etc.) on the first pages of the manuscript should also be stated in English. In studies with more than one author, the contribution rate and conflict of interest statements of the authors should be included in the article text.
Article subheadings, the words “Abstract” as the title of the Turkish abstract, “Abstract” as the title of the English abstract, and the title “Keywords” should be written in bold and capitalized.

6) Ethics Committee Permission
In our journal, all studies that require ethics committee approval must be approved by the relevant committee. Surveys, experiments, observations, clinical and animal studies and research involving personal data are subject to ethics committee approval. This permission must be clearly stated in the text of the article. Studies without ethical approval are not evaluated. Scientific research on humans and animals must be conducted in accordance with the Declaration of Helsinki and ARRIVE guidelines and approval must be obtained from the relevant ethics committee. Studies without ethics committee approval are not evaluated in our journal.

7) TEXT
The text of the article and subheadings within the text should be prepared in 12 pt, 1.5 line spacing, left justified and organized as follows.

8) NOTES and REFERENCES
Chicago” citation system is adopted in footnotes and bibliography. Works that do not comply with the relevant citation procedure will be returned to the author. The footnotes of the article should be shown at the bottom of the page and should be prepared with 10 font size and single line spacing. Footnotes used at the end of a sentence should be given without a space before the end-of-sentence punctuation mark.

9) REFERENCES
At the end of the article, there must be a Bibliography section at the end of the article, starting on a separate page, listing the sources used in the article. The title of the bibliography should be written in bold, 12-point font, in all capital letters and should be justified on both sides. The bibliography should be ordered according to the alphabetical surnames of the authors. The works in the bibliography should also be in 12-point font and justified on both sides. The bibliography section should always start on a new page.

10) FOREIGN WORDS AND ABBREVIATIONS
Foreign words used in the text must be italicized. However, if the publication language of the work is Turkish, the Turkish equivalent of the expressions other than the original name of the work should be written in the bibliography or footnotes.
For example: “volume” for ‘volume’, ‘issue’ for ‘issue’, ‘edited by/editor’ for ‘editor’, ‘editors’ for ‘editors’.
It is not obligatory to prepare a table of abbreviations. However, if an abbreviation is used in the text, the abbreviated expression should be written without abbreviation in the place where this abbreviation is used for the first time and the abbreviation should be included in parentheses.

ETHICAL PRINCIPLES
The ethical principles and publication policy of the Journal of Ankara University Faculty of Law have been prepared in accordance with the guidelines and policies published by the Committee on Publication Ethics (COPE).

Actions Contrary to Scientific Research and Publication Ethics
• Plagiarism: Representing the original ideas, methods, data or works of others as one's own work in whole or in part without citation in accordance with scientific rules,
• Forgery: Using non-existent or falsified data in scientific research,
• Distortion: Falsifying research records or data obtained, falsifying devices or materials that were not used in the research, falsifying or shaping the results of the research in line with the interests of the persons and organizations receiving support,
• Republishing: Presenting duplicate publications as separate publications for academic appointments and promotions,
• Slicing: Inappropriately and inappropriately dividing the results of a research into parts in a way that disrupts the integrity of the research and publishing them in more than one issue and presenting these publications as separate publications in academic appointments and promotions,
• Unfair authorship: Including or excluding people who have not actively contributed, changing the author ranking in an unjustified and inappropriate manner, removing the names of active contributors from the work in subsequent editions, using one's influence to have one's name included among the authors even though one has not actively contributed,

ETHICS COMMITTEE PERMISSION
Our journal requires that the relevant ethics committee decision must be obtained for all studies in all disciplines that require ethics committee approval. In this context, authors should write the date and number of the Ethics Committee approval on the first or last page of the article.
In line with the regulations implemented by Ulakbim TR Index since 2020, studies that do not have ethics committee permission are not evaluated in our journal.

Studies Requiring Ethics Committee Approval
In our journal, research that requires ethics committee permission includes the following studies:
• All research conducted with qualitative or quantitative approaches that involve collecting data from participants through methods such as surveys, interviews, focus groups, observations, experiments and interview techniques,
• Studies in which humans and animals (including materials or data) are used for experimental or other scientific purposes,
• Clinical trials conducted on humans,
• Scientific research on animals,
• Retrospective studies within the framework of the Personal Data Protection Law.
In order for such studies to be included in the evaluation, the relevant ethics committee permissions must be obtained and these permissions must be clearly stated in the text of the article.

NOTE: Scientific research on humans and animals must be conducted in accordance with the Declaration of Helsinki and ARRIVE guidelines and approval must be obtained from the relevant ethics committee. Studies without ethics committee approval are not evaluated in our journal.

Relations with Journal Owner and Publisher
The relationship between the editor and the publisher is based on the principle of editorial independence. In accordance with the written contract between the editor and the publisher, all editorial decisions are independent of the publisher and the journal owner.

Correction, Retraction, Expression of Concern
Editors may consider publishing a correction if minor errors are identified in the published article that do not affect the findings, interpretations and conclusions. In the case of major errors/violations that invalidate findings and conclusions, editors should consider retracting the article. COPE principles are taken into account in relation to correction, withdrawal or expression of concern.

Protection of Intellectual Property Rights
Our journal is obliged to protect the intellectual property rights of all published articles and to defend the rights of the journal and the author(s) in case of possible violations.

Protection of Personal Data of Participants
All personal data sent to our journal are protected in accordance with legal regulations and ethical rules.

Complaints
Any unethical behavior of the editors, referees, or authors of the Ankara University Journal of Law Faculty, or any unethical situation in the review process, in early view, or in relation to a published article should be reported to auhfd@law.ankara.edu.tr. Our journal follows the procedure outlined in the COPE flowcharts for complaints.

Conflicts of interest
Our journal guarantees the independent and impartial completion of the publication process, taking into account the conflicts of interest between the author(s), reviewers and other editors.

Change of Author
Only the article is processed before acceptance. Authors are required to carefully review the list and order of authors before submitting their manuscript and provide the final author list at the time of original submission.

Use of Artificial Intelligence
The use of artificial intelligence in processes that do not affect the originality of the article, such as literature review or language control, is acceptable in studies submitted to our journal. However, the use of artificial intelligence should be carried out within the framework of ethical rules and should never be used for unethical purposes such as fabricated data and manipulation.
For studies involving the use of artificial intelligence, it is mandatory to inform our journal about this situation at the article submission stage. All responsibility for the use of artificial intelligence belongs to the authors themselves.

Responsibilities of Stakeholders

Obligations of the Editorial Board
a) The editors and assistant editors of the Journal are obliged to fulfill their duties in an objective and impartial manner, free from any prejudice.
b) The editors and assistant editors of the Journal are obliged to act in confidentiality to the extent required by their duties.
c) The editors and assistant editors of the Journal act in full cooperation in all kinds of business and transactions related to the Journal. Fair distribution of tasks within the journal constitutes the essence of cooperation.

Obligations of Authors and Referees
a) Authors who wish to have their works published in the Journal are obliged to comply with the provisions of the Law No. 5846 on Intellectual and Artistic Works, the principles set out by YÖK in the Scientific Research and Publication Ethics Directive, the standards set forth by COPE and other principles and standards accepted by the Journal.
b) Authors are deemed to have undertaken that they have prepared their works submitted to the Journal for publication in accordance with the relevant provisions, principles and standards.
c) Referees carefully and promptly review the works sent to them by the Journal or the units authorized by the Journal; they evaluate the works in an impartial and fair manner in accordance with their areas of expertise.
d) Reviewers are obliged to inform the editorial board of the Journal immediately if they find any violation of academic principles and ethical values, national or international principles or standards in the works they evaluate.

PUBLICATION POLICY

General Principles
• The Journal of Ankara University Faculty of Law aims to support developments in all areas of law by including original scientific research and reviews. The main problems encountered in the field of law in Turkey and in the world, scientific solution proposals and new theories are the primary areas of interest of the Journal. In this context, works that contain innovative approaches to their subjects, scientifically examine legal concepts and institutions, examine field research and their results, and translations with high academic value are among the works that can be published in the Journal. In this context, translations, decision and book reviews, legislative evaluations and informative notes are included.
• The works to be published in the Journal can be written in Turkish, English, German or French. The works submitted to the Journal must comply with the rules of spelling, spelling and citation.
• Works are sent to the Journal via the Dergipark system. All submitted works must be original, unpublished, and not in the process of evaluation in another periodical.
• Authors are deemed to have accepted that their works are ready for “publication” as submitted to the journal. Each work is reviewed by one of the editors and at least two referees. In the review, the editors reject the manuscripts that do not comply with the scientific criteria and the spelling rules stipulated for the journal and that contain more than usual spelling mistakes. Within the scope of this review, a plagiarism check is also performed.
• The peer review of the works is carried out within the framework of a double-blind refereeing system. If a correction is requested, the author can only make changes within the framework of the specified corrections. After the corrections suggested by the referees are made by the author, the work is sent for peer review again if specified in the report. If one of the referee reports is positive and the other negative, a third referee evaluation is applied. The final decision on whether or not to publish the articles belongs to the editor-in-chief. The editor's decision is final.
• The opinions in the works published in the journal and the responsibility for these opinions belong to the author.
• All works that do not comply with accepted ethical standards are removed from publication. This includes manuscripts containing possible irregularities and nonconformities detected after publication.
• Authors agree to transfer their copyrights to our Journal under the CC BY-NC-ND 4.0 license when the article is accepted for publication.
• All articles published as open access in our journal are licensed under Creative Commons Attribution-NonCommercial-Non-Derivatives 4.0 International (CC BY-NC-ND 4.0).
• Articles published in our journal are digitally archived in LOCKSS and DSpace. Articles published in our journal can be accessed free of charge at https://dergipark.org.tr/en/pub/auhfd/archive.
• The publication of articles in the journal and the execution of article processes are not subject to any fee. No processing or submission fee is charged for articles submitted to the journal or accepted for publication.

Special Issue Policy
With the decision of the Editorial Board, a special issue may be published once a year. For articles to be published in the special issue, the publication and evaluation principles are applied as applied in the planned issues.

Price Policy
Article submission, evaluation and publication processes in our journal are completely free of charge. No fee is charged for articles submitted or accepted for publication. In accordance with our publication policy, sponsorship and advertising are not accepted and all expenses of our journal are covered by Ankara University.
